Eli Lilly and Company initiated a UDRP proceeding against Nozipho Moloi regarding the domain <cheapestmounjaro.com>. The Complainant argued that the registration exploited their well-known pharmaceutical trademark for Mounjaro, a medication used for type 2 diabetes and weight management. According to the Complainant, the Respondent used the domain to lure consumers looking for discounted medication, creating an unauthorized association with the official brand without any legal authorization or affiliation.

Validating Trademark Integrity Over Generic Descriptive Terms

The administrative decision centered on the fact that the domain name directly incorporated the Complainant’s entire trademark alongside the descriptive word “cheapest.” This combination did not distinguish the domain from the official brand but rather increased the likelihood that internet users would mistakenly believe the site was an authorized outlet or a legitimate source for discounted products. Furthermore, the Respondent lacked any prior permission to use the name and failed to demonstrate a genuine commercial use that did not infringe on existing trademarks. The evidence suggested the domain was registered specifically to capitalize on the global reputation of the Mounjaro brand, diverting traffic for commercial gain through a site that lacked transparency regarding its relationship with the trademark owner. Consequently, the transfer of the domain was ordered.
