In this UDRP proceeding, Estafeta Mexicana, S.A. De C.V. (the Complainant) filed a complaint against Werner Muller (the Respondent) regarding the domain <estafeta.shop>. The Complainant, a leading courier and logistics firm in Mexico, argued that the registration was an unauthorized attempt to capitalize on their long-standing trademark. They asserted that the Respondent had no connection to the brand and registered the name specifically to target the reputation of their shipping and delivery services.

The Basis for Domain Restoration

The administrative decision determined that the registration of <estafeta.shop> could not stand due to the clear overlap between the domain and the Complainant’s protected trademark. The Respondent provided no evidence of a license or permission to use the name, nor were they using the address for a bona fide offering of goods or services. Instead, the combination of a famous logistics brand with a retail-focused extension appeared calculated to divert web traffic and capitalize on the Complainant’s market presence. The lack of any active, non-infringing website further demonstrated that the domain was held primarily to profit from the reputation of the trademark holder rather than for a legitimate commercial purpose.
