The Complainant argued that these domains were registered and used to exploit the established reputation of the SENSEO and TASSIMO trademarks. Specifically, the Complainant highlighted that the Respondent had no permission to use these identifiers and was attempting to mislead consumers by masquerading as an authorized retail partner.

Grounds for the Transfer Order

  1. The domain names directly incorporate the Complainant’s registered trademarks in their entirety, combined with generic terms that imply a commercial relationship, such as “store” and “coffee world.”
  2. There is no evidence that the Respondent is commonly known by these names or holds any legal rights to use the trademarks in a commercial capacity.
  3. The sites associated with these domains were used to host commercial content that mimicked the look and feel of official brand outlets, clearly intended to attract users for profit by creating a false impression of affiliation.

The Respondent went beyond simple domain registration by populating the websites with the Complainant’s proprietary logos and product imagery.
