Prada S.A., the owner of the world-renowned MIU MIU brand, argued that the respondent registered the domain specifically to leverage the luxury label’s reputation. The complainant maintained that the respondent had no authorization to use the trademark and that the domain was designed to mislead the public into believing the site was an official retail platform or an authorized distributor of Miu Miu products.

Why the Domain Was Ordered for Transfer

I. The domain name prominently features the protected MIU MIU trademark in its entirety. The addition of the descriptive term “bags” serves only to reinforce the connection to the complainant’s primary business sector, making it highly probable that a consumer would mistake the domain for the brand’s official digital presence.
II. There is no indication that the respondent has any trademark rights to the name or is known by it in any commercial capacity. No permission was granted by Prada S.A. for the respondent to use the brand identity for a “.shop” extension, which is typically reserved for commercial retail activities.
III. Given the global fame of the fashion house, it is clear that the respondent was aware of the brand at the time of registration. The setup of the domain suggests a deliberate attempt to profit from the brand’s prestige by diverting web traffic toward an unofficial source for commercial gain.

Exploiting a Global Luxury Brand

The respondent’s choice of a domain that specifically targets the “Miu Miu” brand alongside the word “bags” suggests a clear intent to capture searches for high-end accessories. The use of a “.shop” extension further implies a commercial storefront, potentially misleading shoppers into believing they were visiting a legitimate outlet for Prada’s subsidiary brand. This behavior illustrates an attempt to trade on the recognition of a famous mark.

This case reinforces the importance of monitoring top-level domains like “.shop,” which are frequently used to host unauthorized retail sites.
