Protecting the TEMPUR Brand from Unauthorized Domain Registrations

News

Dan Foam ApS, the owner of the globally recognized TEMPUR brand, recently initiated a WIPO proceeding against Oliv Widjaya regarding the domain name tempur79.org. As a major manufacturer of mattresses and pillows, the company argued that the registration was an attempt to misappropriate its long-standing reputation. The domain features the core trademark along with a numerical suffix, which the trademark owner claimed was designed to deceive consumers into believing there was an official connection between the website and the authentic bedding products.

Why the Transfer Was Granted

The evidence demonstrated that the trademark is globally recognized and that the registration of tempur79.org was not a coincidence. The domain essentially mirrors the brand name, making it highly likely that visitors would associate the site with the official manufacturer. Furthermore, the respondent lacked any authorization to use the name and provided no evidence of a genuine business operation under that identity. By using a famous brand for a domain that has no legitimate connection to the respondent, the registration creates a risk of consumer deception, leading to the conclusion that the domain was acquired specifically to capitalize on the brand’s established market presence.

Evidence of Intentional Misuse

The choice of a “.org” extension combined with a premium brand name often suggests an attempt to look like an official resource or a community-driven site, further complicating the brand’s control over its digital identity. This opportunistic registration serves as a clear example of how brand equity can be diluted when third parties secure names that are clearly intended to leverage the visibility of a high-value trademark without permission.

Strengthening Brand Defense in the Digital Space

The lesson for established manufacturers is that even small variations—such as adding a few digits to a trademark—can lead to significant brand confusion. It is vital for companies to proactively monitor new registrations across various top-level domains to prevent unauthorized entities from siphoning traffic or damaging the company’s reputation. Effective enforcement requires identifying these patterns early and taking formal action to reclaim digital assets that rightfully belong to the trademark holder.
