Bunge SA, a global leader in agribusiness and food production, initiated a UDRP proceeding against Dream Health MarktFor Tunch concerning the domain names <bunge-bv.com> and <bunge-nl.com>. The Complainant asserted that the registrations were unlawful and designed to exploit its international reputation. According to the Complainant, the Respondent had no authorization to use the protected brand name and sought only to create a false association with the Complainant’s corporate structure.

Assessment of the Infringing Registrations

The decision to transfer the domains was supported by the fact that both <bunge-bv.com> and <bunge-nl.com> incorporate the Complainant’s trademark in its entirety. The addition of “bv,” which denotes a private limited liability company in the Netherlands, and “nl,” representing the country’s geographic code, serves to mimic legitimate corporate naming conventions. There is no indication that the Respondent has any connection to the Complainant or holds any legal right to use the name. The registrations appear to have been made with the specific intent of profiting from the Complainant’s goodwill or misleading the public into believing the domains were official portals for the Complainant’s Dutch operations. Because the Respondent failed to provide any evidence of a legitimate use for the names, the conclusion was reached that the domains were acquired primarily to interfere with the Complainant’s business.

Evidence of Deceptive Targeting

The choice of terms added to the brand name suggests a calculated effort to impersonate the Complainant. By using corporate and regional identifiers, the Respondent created a high risk of deception, which is a common tactic in fraudulent schemes. The lack of any bona fide commercial activity on the websites associated with these domains further demonstrates that the registrations were not intended for any lawful purpose.

This case highlights the vulnerability of global brands to “combosquatting,” where unauthorized parties pair a trademark with corporate suffixes to appear authentic.
